Parking servis' parking ticket legal

Some claims that appeared in the media that parking tickets are unconstitutional are not true, says management of ‘Parking Servis'.

Boban Kovačević, JKP ‘Parking Servis' Managing Director, says that there isn't a possibility that the actions of ‘Parking Servis' in any segment are unconstitutional or illegal and that there is no question that the Constitutional Court made any decision on unconstitutionality of the legality of parking tickets. We would like to inform the public and remove any doubts concerning legality of the parking tickets, says Kovačević.

Charging for the parking tickets in the zoned parts of Belgrade is constitutional and legal, says Milija Lazarević, the head of the legal team and JKP ‘Parking Servis' Deputy Managing Director.

Milija Lazarević explains that the Constitutional Court has never made a decision that the actions of ‘Parking Servis' are illegal. On the contrary, on the City's initiative the decision has been passed on suspending the proceedings at the Constitutional Court for the period of 90 days. Within that timeframe the City, which had passed a Decision on charging for the parking ticket, may specify certain provisions of its Decision and upon the expiry of 90 days the Constitutional Court will be making decision on this case.

It is our intention that by amending certain provision we remove any ambiguities regarding the parking tickets. JKP ‘Parking Servis' carries out control of vehicles on public car parks. Parking tickets are issued to the vehicles which are legally parked in the zoned parking system only if the parking is not paid for or a vehicle is parked in a zone longer than a time limit. Any mention of traffic violation is simply ruled out, says Lazarević, because this parking ticket is not issued for a traffic violation. Parking ticket is a ticket which is used to charge for the service of using the parking place in the zoned area with a time limit. The price of the ticket is determined in the same way as any other city service on the basis of the Decision of the Company Board with the consent of the City competent authority.

S Experts of the Faculty of Transport Belgrade have so far made two studies on zoned parking system which indicate that it is necessary to limit the use of a parking place in order to solve traffic problems. Therefore, a zoned system must be discouraging for those drivers who occupy the place longer than the time limit. This allows for greater utilization of a parking place and protects the rights of residents and disabled people.

In addition, the studies have shown that the zoned system has improved parking in the Capital, because today one parking place is used by 5 to 8 vehicles whereas before it was used by only 1 car. The period for searching a free space has decreased from 30 to 5 to 10 minutes since the zones were launched. Also, by introducing the zones parking places were technically regulated which improved safety of pedestrians and drivers, say the experts of the Faculty of Transport Belgrade.

The City's activities concerning the amendments of the Decision on public car parks cover also other significant changes related to parking and that is a reason to specify certain provisions concerning this issue. These activities will finish by early September. There is no doubt that the current Decision remains in effect and must be adhered to by both Parking Servis and our service users, says Lazarević.
