Keeping of removed vehicles under the order of the competent authority until the collection of receivables due

PUC “Parking servis” Belgrade, pursuant to the Article 36 of the Law on Communal Activities (The Official Gazette of RS, No. 88/11 and 104/16) and the Article 21a of the Decision on Public Parking Lots (The Official Gazette of the City of Belgrade, Nos. 12/10-consolidated text, 37/11, 42/11, 11/14, 30/14, 34/14, 89/14 and 96/16), is authorized to keep a debtor’s motor vehicle removed by an order of the competent authority (Ministry of Interior of RS or the Communal Inspection), until the collection of due receivables.

Due receivables means receivables based on:
  1. issued orders for the payment of daily ticket, in accordance with the applicable Decision on Public Parking Lots and
  2. performed service for removing the vehicle under the order of the competent authority, demurrage costs and other associated costs calculated according to the applicable price list of the Company.

Based on performed service for removing the vehicle under the order of the competent authority, demurrage costs and other associated costs calculated according to the Company’s applicable price list, the debt repayment is performed exclusively by one-off payment, prior to taking over the vehicle. The vehicle can be taken over after effected payment of the debt based on performed vehicle removal service.

Based on issued orders for the payment of daily ticket, the collection of debt due in accordance with the Decision on Public parking Lots is performed:

  1. By initiating the procedure for the collection of receivables, when the debtor (the driver/owner of the vehicle) can be identified through the records of the competent authority of the Republic of Serbia (vehicles registered in the territory of the Republic of Serbia), in which case the retention of removed vehicle is not performed until the collection of receivables based on issued orders;
  2. By keeping the vehicle until the collection of receivables due, when the debtor (the driver/owner of the vehicle ) cannot be identified through the through the records of the competent authority of the Republic of Serbia (vehicles registered in the territory of the Republic of Serbia) and it is not possible to initiate the procedure for the collection of receivables.

By the Decision on the conditions and method of regulating the debt for taking over the vehicle removed under the order of the competent authority, for vehicles with foreign license plates, the conditions and method of regulating the debt by one-off payment and payment in installments are defined more specifically, as follows:

REGULATING THE DEBT

ONE-OFF METHOD

Based on issued orders for the payment of daily ticket , the debt repayment may be performed by ONE-OFF METHOD, for receivables arising from the orders for payment of daily tickets, which became due by the date when removal of the vehicle was performed.

The debtor submits the application for regulating the debt and pays the determined debt at the Company’s authorized cash desk or settles the debt by a transfer order/payment in the Creditor’s current account No. 165-0007007487236-10 with Addiko Bank a.d. Belgrade.

Based on performed service for removing the vehicle under the order of the competent authority, demurrage costs and other associated costs, calculated according to the Company’s applicable price list, the debt repayment is performed exclusively by one-off payment.

INSTALLMENT METHOD

Based on the issued orders for payment of daily ticket , the debt repayment may be performed by INSTALLMENT METHOD, exclusively for receivables arising from the issued orders for payment of daily tickets, which became due by the date when removal of the vehicle was performed, and about which a written agreement is made.

Conditions for entering into agreement on the debt repayment in installments:
  • Debt repayment in installments by mutual agreement may only be approved to a natural person with the residence in the territory of the Republic of Serbia;
  • Debtor (agreement signatory) may be the vehicle owner or authorized user;
  • Minimum amount of receivables due is 50,000.00 dinars (in letters: fifty thousand dinars);
  • The amount of the first installment is one-off payment of 30% of the total receivables due on the date of signing the agreement;
  • The number of the installments of remaining 70% of the debt, defined relative to the amount of the debt:

The debtor submits the application for regulating the debt and after effected payment of the first installment – one-off payment of 30% of the total debt on the date of entering into the agreement, the Debtor is issued a receipt as the evidence for taking over the removed vehicle.

TAKING OVER THE VEHICLE

In case of regulating the debt by one-off payment method, the debtor may take over the vehicle only after submitting the evidence on effected payment of ALL receivables due – both based on the issued orders for payment of daily ticket and based on performed service for removing the vehicle.

In case of regulating the debt by installment method, the debtor may take over the vehicle only after submitting the evidence:
  •  That the payment of the first installment to the amount of 30% of the total debt has been effected
  •  That one-off repayment of the debt based on performed service for removing the vehicle and other costs has been effected

Application for regulating the debt based on the issued orders for payment of daily ticket, on the prescribed form, is submitted on the Company’s ticket office on the following locations:

  • 31 Takovska Street
  • 7 Kraljice Marije Street
  • 51 Mileševska Street

The agreement on the debt repayment in installments is entered into in the premises of PUC “Parking servis”, 31 Takovska Street in Belgrade.
